Terms of Service.

1. Acceptance of these terms

These Terms of Service (“Terms”) govern your access to and use of Growf’s website, applications and API (the “Services”). By creating an account or using the Services, you agree to these Terms on behalf of yourself and any organisation you represent. If you do not agree, do not use the Services.

2. Accounts

You must provide accurate information and keep it up to date. You are responsible for activity under your account and for keeping your credentials secure. Workspace Owners are responsible for managing members, roles and permissions within their workspace.

3. Service availability

The Services are evolving. Features may change, be added or be removed, and the Services may occasionally be unavailable or behave unexpectedly. The Services are provided “as is” so we can keep improving them; we appreciate your feedback and may use it to develop the product without obligation to you.

4. Acceptable use

You agree not to:

• use the Services for unlawful, harmful or infringing purposes;
• upload content you don’t have the rights to use;
• attempt to disrupt, reverse-engineer or gain unauthorised access to the Services;
• use the Services to build a competing product, or to train competing models on outputs;
• exceed documented rate limits or circumvent usage controls.

5. Your content

You retain all rights to the briefs, strategies, assets and other materials you submit (“Your Content”). You grant Growf a limited licence to host, process and display Your Content solely to provide the Services to you and your workspace. You are responsible for Your Content and for ensuring you have the necessary rights and consents.

6. Intellectual property

The Services, including all software, design and brand elements, are owned by Growf and protected by intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Services; they do not transfer any ownership to you. Outputs generated for your workspace are yours to use, subject to these Terms.

7. Fees & billing

Paid plans are billed in advance on a recurring basis. Fees are non-refundable except where required by law. You authorise us to charge your payment method for applicable fees and taxes. We may change pricing with reasonable notice; changes take effect at your next billing cycle.

8. Term & termination

These Terms apply for as long as you use the Services. You may stop using Growf and close your workspace at any time. We may suspend or terminate access if you breach these Terms, fail to pay, or to protect the Services or other users. On termination, your right to use the Services ends; sections that by their nature should survive will continue to apply.

9. Disclaimers

The Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. AI-generated outputs may contain errors; you are responsible for reviewing and approving any output before use. Growf does not guarantee that the Services will be uninterrupted, secure or error-free.

10. Limitation of liability

To the maximum extent permitted by law, Growf will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill. Our total liability arising out of or relating to the Services will not exceed the amount you paid to Growf in the twelve months before the event giving rise to the claim.

11. Governing law

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles. The competent courts of the Netherlands will have exclusive jurisdiction over any dispute, unless mandatory law provides otherwise.
